Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of 3dmybiz.com and related websites, forms, ordering tools, communications, media, and services provided by 3D My Biz, LLC ("3D My Biz," "we," "us," or "our").
By using our website, requesting a quote, placing an order, or accepting services, you agree to these Terms. If you do not agree, do not use the applicable website or service.
1. Additional Project Terms
A quote, proposal, order form, statement of work, invoice, platform agreement, or other written project document may contain additional terms. If a specific written project term conflicts with these general Terms, the specific written project term controls for that project.
2. Services and Estimates
We provide media, reality-capture, and related services that may include photography, video, drone media, 3D scanning, digital twins, Matterport tours, Zillow 3D Home, Google Street View, floor plans, virtual enhancements, product media, hosting, and business-profile support.
Website calculators, package builders, starting prices, verbal ranges, and preliminary quotes are estimates unless expressly identified as fixed. Final pricing may depend on location, square footage, site conditions, access, travel, requested deliverables, licensing, hosting, editing, scheduling, and other project requirements.
3. Orders, Payment, Cancellation, and Rescheduling
Prices, deposits, payment timing, cancellation fees, rescheduling rules, refunds, travel charges, and delivery terms are those shown in the applicable quote, order form, checkout, or written project agreement.
You authorize us and our payment providers to charge amounts you approve. Overdue amounts may delay capture, editing, delivery, publication, hosting, or access to deliverables to the extent permitted by law and the applicable agreement.
Weather, unsafe conditions, property access, airspace restrictions, equipment issues, illness, emergencies, or events outside reasonable control may require rescheduling. We will use reasonable efforts to communicate and reschedule affected work.
4. Client Responsibilities
You are responsible for:
- Providing accurate project, property, contact, billing, and access information.
- Having authority to order services for the property, business, products, people, and materials involved.
- Obtaining permissions, releases, access, parking, security clearance, and site authorization reasonably necessary for the work.
- Preparing the property or site before the appointment.
- Identifying hazards, sensitive areas, restricted content, minors, confidential information, and safety requirements before capture begins.
- Reviewing deliverables promptly and submitting revision requests within any review period stated in the applicable order or agreement.
- Ensuring your use and publication of deliverables complies with law, platform rules, MLS rules, advertising standards, privacy rights, intellectual-property rights, and contractual obligations.
Delays, additional work, or return visits caused by inaccurate information, lack of access, insufficient preparation, or undisclosed conditions may result in additional charges.
5. Drone Services
Drone services are subject to weather, site safety, equipment limitations, airspace authorization, temporary flight restrictions, local restrictions, visibility, and the pilot's safety judgment. A requested flight, altitude, path, angle, or date is not guaranteed.
The remote pilot in command retains final authority over whether and how a flight is conducted. We may postpone, modify, or decline a flight when reasonably necessary for safety or legal compliance.
6. Reality Capture, Measurements, and Floor Plans
Unless expressly agreed in writing and performed by an appropriately licensed professional, our scans, models, point clouds, floor plans, measurements, maps, and related outputs are media, visualization, documentation, or planning-support products. They are not boundary surveys, land surveys, legal descriptions, engineering certifications, architectural certifications, code-compliance determinations, or guarantees of exact dimensions.
Do not rely on these materials where a licensed surveyor, engineer, architect, inspector, or other regulated professional is legally or practically required.
7. Third-Party Platforms
Some services depend on third-party platforms such as Aryeo, Matterport, Zillow, Google, mapping services, listing services, payment processors, hosting providers, and social platforms. Their availability, features, branding, processing, ranking, approval, display, and continued operation are outside our control and subject to their own terms.
We do not guarantee search rankings, listing performance, platform acceptance, web traffic, leads, sales, saves, views, or other business outcomes.
8. Hosting and Recurring Services
3D tours, digital twins, websites, embeds, tags, dashboards, profile management, and related services may require recurring hosting, licensing, management, or platform fees. The applicable order will identify recurring charges and included services.
If recurring service is canceled or unpaid, the associated tour, embed, dashboard, tag, hosted asset, or managed feature may be suspended or removed after any applicable notice or grace period. Cancellation of hosting does not require a third-party platform to provide an export or preserve functionality that depends on that platform.
9. Intellectual Property and License
Unless a written agreement states otherwise, 3D My Biz and its licensors retain ownership of copyrights, production files, templates, software, methods, designs, and other intellectual property created or used in providing services.
After full payment, you receive the license described in the applicable order or agreement. If no specific license is stated, you receive a non-exclusive, non-transferable license to use the final delivered media for the business, property, listing, campaign, or project for which it was ordered. You may not resell, sublicense, scrape, reverse engineer, remove rights-management information from, or use deliverables to train an artificial-intelligence model without written permission.
The license is granted to the client who ordered and paid for the project, and to that client's brokerage, MLS, and listing-syndication partners for the listing or campaign it was ordered for. It does not transfer to any other agent, brokerage, owner, builder, developer, property manager, tenant, or business. If a property is relisted or a business changes hands and a new party wishes to use existing media, that party must purchase a relicense from 3D My Biz. Use of our media without a license, or beyond the scope of a license, may be invoiced at our then-current license price for each item and use, plus any costs of enforcement, without limiting our other remedies. Hosted 3D tours and embeds may be shared only through the links and embed codes we provide.
Third-party music, fonts, stock assets, platform content, and software remain subject to their respective licenses.
10. Portfolio Use
Unless prohibited by a written agreement, legal restriction, confidentiality obligation disclosed before capture, or a timely written request, we may display non-confidential final work to identify and promote our services, including in portfolios, proposals, social media, awards, demonstrations, and advertising.
We will not intentionally publish private access information, alarm details, lockbox codes, or other information that we reasonably understand creates a security risk.
11. Acceptable Use
You may not use our websites, forms, services, or deliverables to:
- Violate law or another person's rights.
- Transmit malware, interfere with security, or attempt unauthorized access.
- Submit content you do not have authority to use.
- Harass, defraud, impersonate, or mislead others.
- Scrape, copy, reverse engineer, or commercially exploit our website, software, or systems except as expressly permitted.
12. Text Messaging Terms
If you affirmatively opt in, 3D My Biz may send text messages to the telephone number you provide. Depending on the opt-in selected, messages may include quote responses, appointment reminders, access coordination, weather or schedule updates, service notifications, delivery notices, support, account messages, and promotional offers.

- Consent to marketing messages is not a condition of purchase.
- Carriers are not liable for delayed or undelivered messages.
- You represent that you are the subscriber or authorized user of the number provided and will notify us if the number changes.
Your participation is also governed by our Privacy Policy. Mobile information and SMS opt-in consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.
13. Payment Timing, Late Payment, and Collections
Unless the applicable order or written agreement states otherwise, payment is due in full upon delivery, and final deliverables, download links, hosted tours, embeds, and publication to third-party platforms are released or activated only after payment in full. Until payment in full is received, all deliverables remain our property and no license is granted. We may require a deposit for large, custom, multi-day, travel, or commercial projects, and deposits are applied to the final invoice.
Amounts not paid within 30 days of the invoice date may accrue a late charge of 1.5% per month, or the maximum rate permitted by law if lower. You agree to reimburse our reasonable costs of collection, including collection-agency fees, court costs, and attorneys' fees, to the extent permitted by law. If a payment is reversed, disputed, or charged back without a valid basis, we may suspend hosting, remove published media, revoke the license for the affected deliverables, and decline future work until the matter is resolved.
14. Deliverables, Revisions, Acceptance, and File Retention
Deliverables are considered accepted if we do not receive a written revision request within 7 days of delivery, or within the review period stated in the applicable order. Unless the order states otherwise, one round of reasonable revisions consistent with the original order is included. Additional edits, changes of creative direction, re-shoots, return visits, and requests after the review period are billable at our then-current rates. Raw, unedited, or native files are not part of any deliverable unless expressly agreed in writing.
We are not an archive or backup service. You are responsible for downloading and backing up delivered files. We may retain project files for a limited period after delivery as a courtesy, after which they may be permanently deleted without notice. Real estate 3D tours are typically archived or taken offline after the listing closes unless a hosting plan is in place. Retrieval, re-delivery, re-activation, or re-export of archived material, where still possible, may be subject to a fee.
15. People, Property Access, Releases, and Virtual Enhancements
You are responsible for obtaining any consent, model release, or permission needed from people who appear in photographs, video, 360° imagery, or 3D scans, including staff, customers, tenants, occupants, and family members, and for notifying tenants and occupants of a scheduled capture as required by law or lease. You confirm that you have authority to have the property, business, products, artwork, signage, and materials captured and published. We may ask people to step out of frame and may decline to capture areas we consider unsafe, private, or restricted.
Virtual staging, virtual twilight, item and blemish removal, sky replacement, virtual renovation, AI-assisted enhancement, and similar edits are visual marketing tools and do not represent the actual condition of a property. You are solely responsible for disclosing virtually altered images as required by MLS rules, advertising law, and fair-housing and consumer-protection laws, and for not using altered images to misrepresent a property. Where we label an image as virtually staged or enhanced, you may not remove or crop out the label. You are responsible for compliance of any deliverable that you publish, and for the accuracy of any listing information, square footage, or claims that you attach to our media.
16. Google Street View, Google Business Profile, and Zillow Services
Publication of imagery to Google Street View and Google Maps, changes to a Google Business Profile, publication of Zillow 3D Home tours, and similar platform services are subject to each platform's policies, review, moderation, and timing. We do not control, and do not guarantee, approval, publication date, placement, retention, ranking, verification, or the continued availability of content on any platform, and a platform may remove, edit, or relocate content at any time. You confirm that you are the owner or an authorized representative of any business profile or listing you ask us to work on, and you agree to grant us the access we reasonably request to perform the work. We are not responsible for a suspension, removal, or loss of a profile or listing caused by your actions, information you provided, a platform's policy change, or a platform's independent decision.
17. Beta Features and Website Content
Features identified as beta, preview, or experimental, including online order builders, pricing calculators, the My Project page, and interactive tour experiences, are provided for convenience and may be incomplete, contain errors, change, or be withdrawn at any time. Prices, availability, and totals shown by these tools are estimates that are confirmed only by the final order or invoice. Website content, including portfolio examples, statistics, and descriptions of platform features, is provided for general information, may not reflect current platform behavior, and is not professional, legal, real estate, or financial advice. We may correct errors and update content without notice.
18. Events Beyond Our Control
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including weather, fire, flood, earthquake, wildfire smoke, power or internet outages, platform or service-provider outages, airspace restrictions, government orders, public-health events, labor disputes, transportation disruption, illness or injury, or acts of third parties. In those cases the affected obligations are suspended for the duration of the event and we will use reasonable efforts to reschedule or resume the work.
19. Disclaimer of Warranties
To the fullest extent permitted by law, our websites, estimates, and services are provided "as is" and "as available," except for express commitments in a written project agreement. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent legally permitted.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
20. Limitation of Liability
To the fullest extent permitted by law, 3D My Biz and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or platform visibility arising from or related to the website, services, or deliverables.
To the fullest extent permitted by law, our total liability arising from a particular project will not exceed the amount paid to 3D My Biz for the specific service giving rise to the claim during the twelve months preceding the event. This limitation does not apply where prohibited by law.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless 3D My Biz and its owners, personnel, and contractors from claims, losses, liabilities, damages, and reasonable costs arising from your breach of these Terms, your supplied content or instructions, your lack of authority or permissions, or your unlawful use of services or deliverables.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a claim, the parties agree to make a good-faith effort to resolve the dispute informally by written notice and discussion for at least 30 days, unless urgent injunctive relief is reasonably necessary.
Any legal proceeding that is not resolved informally will be brought in a court of competent jurisdiction in California, unless applicable law requires otherwise.
23. Changes to These Terms
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless otherwise stated or required by law.
24. Severability and Waiver
If a provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
